Step 1 of the abatement for this violation required that <br />plans be submitted for backfillinq and grading the Fruita #1 <br />bench area by October 23, 1991. <br />As you are aware, the reason for the extension request is that <br />the owner of the coal leases, Al Hoyle, desires to open a new <br />mine in the Cameo seam utilizing the bench area for the portals. <br />He is adamantly opposed to any reclamation of the bench area <br />since it will impair his ability to open the mine. Also, the <br />surface owner, Dan Lynch is also adamantly opposed to any <br />reclamation of the bench area since it will lower the value of <br />his property. Hoyle has said he would legally fight any <br />reclamation work on the site. <br />An extension of 30 days is needed to work out some agreement <br />among American Shield, Al Hoyle and MLRD on the matter of the <br />bench area.
