In that letter, the <br />Deputy Director found that a violation existed at the Roadside Mine <br />because the sumps at the North Decline had not been certified by a <br />registered professional engineer. The Deputy Director instructed the <br />AFO to conduct another federal inspection of the mine. <br />Enclosed are copies of certifications for the North Decline sumps <br />which were prepared by Powderhorn Coal Company. I understand that an <br />AFO field inspector reviewed the original documents during the <br />February 23, 1993 Federal inspection. As the certifications have been <br />prepared, it would appear that a violation no longer exists at this <br />site. <br />Since the violation cited in the TDN does not exist at this time, and <br />because the AFO has apparently viewed these documents, it would not <br />appear that another Federal inspection or further enforcement actions <br />are necessary. However, should the AFO determine to conduct yet <br />another inspection, we would appreciate being notified at least three <br />days in.advance for the purpose of conducting a joint inspection. <br />Please contact me if you have questions or comments. <br />Sincerel , <br />Steven G.
