The
deposition indicates that Battle Mountain Resources encountered water 15 feet
below the surface in the area of the tailings impoundment when installing the
liner. Battle Mountain attributed this water to recent rains.
While the Division takes into account non-physical evidence such as
depositions in our regulation of mining operations, our decisions and
recommendations for items such as the structu ral integrity of a ta,~lings
impoundment must be based upon physical data. We shall continue to rely on
such evidence for monitoring of the Battle Mountain Resources, Inc. San Luis
Project, as well as for all existing and future operations.
We appreciate your bringing this item to our attention
hesitate to call me for any further assistance.
Sincerely,
U~LLG-k~LC '.y`'`Z~
Daniel I.
