The <br />deposition indicates that Battle Mountain Resources encountered water 15 feet <br />below the surface in the area of the tailings impoundment when installing the <br />liner. Battle Mountain attributed this water to recent rains. <br />While the Division takes into account non-physical evidence such as <br />depositions in our regulation of mining operations, our decisions and <br />recommendations for items such as the structu ral integrity of a ta,~lings <br />impoundment must be based upon physical data. We shall continue to rely on <br />such evidence for monitoring of the Battle Mountain Resources, Inc.
