<br />NOV C-93-104 <br />Twin Pines Mine <br />This NOV was issued for failure to pass surface runoff from a coal <br />refuse pile through a sediment treatment facility prior to leaving <br />the permit area. <br />HISTORY <br />NOV C-92-025 was issued at the Twin Pine Mine on July 16, 1992. <br />The NOV was subsequently vacated. NOV C-93-081 was issued on May <br />28 1993. The time period for administrative appeal of the is NOV <br />has not yet expired. No penalty is assessed for history. <br />SERIOUSNESS <br />The quantity and quality of untreated water leaving the permit area <br />are unknown. Therefore, it is impossible to determine the extent <br />of damage that actually occurred, other than the resultant erosion <br />on the slope below the refuse pile. The potential for degradation <br />of surface water quality beyond the permit area was created by this <br />violation. $500 is assessed for moderate seriousness due to the <br />potential for off-site damage. <br />FAULT <br />Based upon photos and comments by the operator, it appear that <br />failure of the diversion system below the refuse pile was due to a <br />combination of a severe storm event and spillage or slumping of <br />refuse material into a ditch. The operator was negligent in not <br />maintaining the ditch so as to route runoff from the pile to a <br />pond, as designed. $250 is assessed for negligence. <br />GOOD FAITH <br />There is no evidence of rapid or extraordinary abatement measures <br />in the file at this time. No credit is awarded for good faith at <br />this time. <br />
