Introduction This document is the decision package prepared by the Colorado Mined Land Reclamation Division (the Division) for the Colowyo Mine. This document updates the findings documents prepared in 1982, 1987 and 1989, and includes: 1) the proposed decision to approve the permit revision application; 2) a summary which includes: a history of the review of the permit application, a description of the environment affected by the operation and a description of the mining and reclamation plan; and 3) the written findings of compliance the Division has made as required by the Colorado Surface Coal Mining Reclamation Act. Detailed information concerning the findings of compliance can be found in the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. The Division has received an application for a permit revision (PR-O1) to conduct surface coal mining and reclamation operations at the Colowyo Mine. The application was submitted by Colowyo Coal Company and the mine will be operated by Colowyo Coal Company. The mine is located on federal, state and private lands within Moffat and Rio Blanco Counties, Colorado. The legal description of the lands included within the permit area is: Township 4 North, Range 93 West, portions of Sections 15, 22, 23, 26, 27, 28, 33, 34; Township 3 North, Range 93 West, portions of Sections 2, 3, 4, 8, 9, 10, 11, 14, 15, 16, 17, 20, 21, 22; West of the 6th P.M. A more precise legal description can be found on page 2.03-15 of the permit application. The mine site can be located. on the following U.S. Geological Survey 7.5 minute maps: Axial, Colorado, and Ninemile Gap, Colorado. Proposed Decision The Colorado Mined Land Reclamation Division proposes to approve an application for a permit revision which entails adding 1,878 acres to the permit area along with adding two additional open pit mining areas (Section 16 and West Pits). The application was submitted by Colowyo Coal Company for the Colowyo Mine. This decision is based on a finding that the operations will comply with all requirements of the Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request for a formal hearing is made withtn thirty <30) days of the first publication of the issuance of this proposed decision, then this decision becomes final upon submittal of acceptable surety by the applicant. The permit application, all supporting documentation and any stipulations or conditions will become a binding part of the permit.
