Recommendation <br />I recommend termination of Federal permit CO-0015, issued on February 22, <br />1983. for Colowyo Coal Company's Colowyo mine. My recommendation is based <br />on the existence of the Colorado cooperative agreement which provides for <br />the delegation to the Colorado Mined Land Reclamation Division (NERD) of <br />the permitting responsibilities for operations on Federal lands pursuant to <br />Section 523 of SMCRA; the issuance of the Colorado State permit C-81-019; <br />incorporation of all necessary Federal permit conditions in the State <br />permit; and review of the mining plan approved on February 18, 1983, for <br />Federal leases D-034365 and C-35874. The applicable conditions of *. he <br />existing approval of the mining plan, which were previously incorporated in <br />the Federal permit, are appended to this memorandum as Attachment A. <br />The termination of the Federal permit is being done in conjunction with the <br />renewal of the Colorado State permit C-81-019. Colorado MLRD reviewed the <br />permit application package (PAP) under the Colorado State program, the <br />Federal leads program (30 CFR Chapter YII, Subchapter D) and the Colorado <br />cooperative agreement (30 CFR 906.30) and issued Colorado permit C-81-019 <br />xhich authorizes surface coal mining and reclamation operations on Federal <br />and non-Federal lands in the permit area pursuant to the State program and <br />cooperative agreement. ~A copy of the bond in the amount of $8,747,405 <br />payable to the United Stage and the State of Colorado, is on file with <br />OSMRE. <br />
