Camarry <br />Division Director <br />Natural Resource Trustee <br />Listed below are adequacy review comments for the Riverbend Operation 112 (c) Amendment (AM-01) <br />Application, File No. M-2000-016. The Division of Minerals and Geology ("Division") is required to make a <br />recommendation decision no later than October 27, 2005, therefore, your response to the following adequacy <br />review concerns should be submitted to the Division as soon as possible. <br />Rule 6.4.7 Exhibit G -Water Information <br />In an attempt to fulfill the requirements of Rule 3.1.6 (1) of the Construction Material Rules and Regulations, <br />which requires that disturbances to the prevailing hydrologic balance of the affected land and to the <br />surrounding azea and to the quantity and quality of water in surface and groundwater systems both during and <br />after the mining operation and during reclamation shall be minimized, the division has been working with <br />Lafarge and Tetratech RMC to establish a monitoring plan that should protect the interests of well owners and <br />vegetation in the area of the project. On October 6, 2005, a meeting was held at the Denver office of the <br />DMG to address these issues. A monitoring plan with mutually agreed upon monitoring well locations and <br />time schedules relative to mining at the site was established. Please submit the monitoring plan established as <br />a result of this meeting. <br />2. In a letter from Tetra Tech RMC addressed to Carl Mount (DMG) titled "Sixth Adequacy Review Response, <br />Lafazge West, Inc. Riverbend Operation 112(c) Permit Amendment Ol, Permit no. M-2000-016," Tetra Tech <br />states under numerous circumstances that agreements between owners of man-made structures and Lafazge <br />West, Inc. will be submitted to the Division as they aze received. Specifically: item #3 refers to an agreement <br />with the owner of well 13697; item #4 refers to an agreement with the owner of well; item #10 refers to 600- <br />foot well spacing agreements, and; item #12 refers to signed agreements with the Lupton Bottom Ditch <br />Company and the Brighton Ditch Company. The Division, at the recommendation of the Attorney General's <br />Office, requires that these documents be submitted prior to approval of this amendment. Please submit the <br />required documents. <br />3. The Division of Minerals and Geology is consulting with a representative of the Attorney General Office to <br />determine whether the Division can approve of language contained under the 5's bullet of the "Wells" section <br />of attachment A to the 6s' Adequacy Review Responses and will forward those comments to LaFazge as soon <br />as they are received. <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
