History of any and all past violations and timeliness of corrective fictions. <br />See attached <br />STAFF RECOMMENDATION(S) (To be completed by the staff) <br />Violation(s): Find the operator in violation of the March 24, 1 X98 order to submit <br />an annual report and pay the annual fee and ci~lil penalty. <br />Board Order: Staff recommends that the Board revoke Permitw M-84-013 and <br />forfeit the $1,000.00 financial warranty (in the fq'rm of a certificate <br />of deposit drawn on the First Bank of Wheatrid~ and numbered <br />231-691-8654) pursuant to the provisions of C. S. 34-32-124. <br />Corrective Actions(s): <br />CIVIL PENALTY <br />A person who violates any provision of a permit issued under C.R.S. 34-32 101 et. sea. shall <br />be subject to a civil penalty of not less than $100 per day, nor more than $ ,000 per day for <br />each day during which such violation occurs. Any operator who operates nder a permit <br />issued under section 34-32-110 shall be subject to a civil penalty of not les~ than fifty dollars <br />nor more than two hundred dollars per day for each day during which such (violation occurs <br />(C. R.S. 34-32-124(7)). <br />No civil penalties are recommended in this case because civil penalties of x$225.00 were <br />levied on March 24, 1998. <br />SUSPENSION OF CIVIL PENALTIES <br />The Board may suspend all or a portion of the civil penalty to encourage timely compliance with the <br />corrective actions, and compliance with the Act and Rules and Regulations. <br />The Board may also suspend all or a portion of the civil penalty based on the per ittee's efforts to <br />correct the violation(s) prior to the Board hearing. The permittee has completed t~e following actions <br />as of May 27, 1998, in order to correct the listed potential violation(s): NONE <br />2 <br />
