SNELTON, Dlroctor
DATE: November 2, 1984
T0: American Fuels, Inc. Enforcement File
FROM: Susan Mowry ~,~
RE: Fixed Civil Penalty for NOV C-84-151
The civil penalty was proposed on October 11, 1984 at $314.00. This included
$150.00 for history and $164.00 for seriousness. No assessment was included
for fault (see October 11, 1984 memo to file).
The operator submitted letters on October 1, 1984, and October 11, 1984
detailing their efforts to abate the violation. These letters indicate that
the violation was abated promptly following my inspection and well ahead of
the abatement deadline. Abatement was verified in the field on September 26,
1984. The operator did not request an informal assessment conference.
I am therefore proposing a reduction for good faith in the fixed penalty of
25%. Therefore the penalty shall be fixed at $235.00.
/fw
Ooc. No. 5197
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel. (303) 866-3567
