16. Please provide along-term groundwater monitoring program for the site to ensure the applicant stays <br />above the seasonal high groundwater elevation. The Division would allow for quarterly monitoring <br />once the baseline groundwater elevations have been established. The applicant will need to connnit <br />to submitting all groundwater elevation data in the Annual Reclamation Report. Please address <br />accordingly. <br />17. Please state if water will be used for operations in the processing plant, the asphalt batch plant and/or <br />the concrete plant. )f so, please state the amount of water needed far these processes and describe the <br />water rights associated for such use. <br />18. The applicant states that there are no expected impacts on water resources by this proposed operation. <br />Please describe any possible impacts to the 5 springs noted on site and impacts to their associated <br />users. <br />Rule 6.4.8 Exhibit H- Wildlife Information <br />t9. Section (1) (c) requires the Applicant/Operator to included the presence and estimated population of <br />threatened or endangered species from either federal or state lists. In that the azea and the habitat <br />present on the proposed site may likely be home to federally listed species, it is necessary for the <br />Division to receive a letter from the U.S. Fish and Wildlife Service an/or the Division of Wildlife <br />indicating that the mining plan has cleazance through them prior to approval of the pemut. Please <br />contact the Division of Wildlife and/or the U.S. Fish and Wildlife Service regarding the proposed <br />mining operation. <br />20. Section (1) (d) requires the ApplicandOperator to include a description of the general effect during <br />and after the proposed operation on the existing wildlife of the azea, including but not limited to <br />temporary and permanent loss of food and habitat, interference with migratory routes, and the general <br />effect on the wildlife form increased human activity, including noise. Please include the above <br />requested information regarding the operation's effect on wildlife at the site. <br />Rule 6.4.10 Exhibit J- Vegetation Information <br />21. Please inform the Division if any wetlands aze present on site, or that maybe affected by the mining <br />and reclamation activity. If so, please depict the areas on the applicable exhibit. <br />Rule 6.4.13 Exhibit L-Reclamation Cost Estimate <br />22. The Division will estimate a cost to reclaim the site once the adequacy questions have been <br />addressed. <br />Rule 6.4.13 Exhibit M- Other Permits & Licenses <br />23. Please be aware that a CDPS Stormwater permit and an NPDES permit maybe required for this site. <br />If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it must <br />be released to the stream system within 72 hours. This may require a discharge permit from CDPHE- <br />WQCD. Otherwise, the operator will need to make replacements for evaporation. <br />Rule 6.4.19 Exhibit S- Structures within 200 feet <br />24. Exhibit C-3 indicates that two houses will be removed. Please state if the removal of these structures <br />is a direct result of the mining operations. The houses do not fall within the proposed mining <br />operations or affected land. If so, please provide notarized agreements with the owners of the <br />structures to remove them from the site in accordance with Rule 6.4.19. <br />
