STATE OF COLORA00 MINED LAND RECLAMATIDN BDARD DEPARTFiENT OF NATURAL RESOURCES IN THE MATTER OF: ) NOTICE OF VIOLATION MV-84-006 Pueblo Paving, Inc. ) AND CEASE AND DESIST ORDER T0: Pueblo Paving, Inc. and all other persons engaged in or owning or controlling the following operation: Mining operations described under Mined Land Reclamation Board Permit Numbers 80-233 and 80-246. FINDINGS OF FACT Pursuant to the authority vested 1n the State of Colorado Mined Land Reclamation Board by C.R.S. 1973, 34-32-124, as amended, the Board hereby makes the following findings of fact: 1. Pueblo Paving, Inc. is conducting mining operations in the following locations: as described in the legal descriptions under Mined-Land -- - Reclamation Board Permit Numbers 80-233 and 80-246. 2. Pueblo Paving, Inc. has failed to maintain adequate financial warranties for Permit Numbers 80-233 and 80-246. Financial warranties for both permits have been cancelled by the surety, a fact of which you were notified in correspondence from Michael Stanton dated October 13, 1983. NOTICE OF VIOLATION You are hereby notified that the facts stated above constitute a violation of Permit Numbers 80-233 and 80-246. The specific permit provisions that have been violated are, for Permit Number 80-246: 1. Recital C, paragraph 1, beginning at the bottom of page 1 and ~ Recital C; paragraph 3 nn page 2, a1-Pe.rmit_Number-80-24b-issued =to-~nur -. company on February 28, 1981; - -- - - - 2. Under-the section labeled "GRANT CONDITIONS AND AGREEMENTS;"- -- condition and agreement number 1 on page 3 of Permit Number 80-246 issued to ---- your company on February 28, 1981.
