Cattany <br />, Division Director <br /> Natural Resource Trustee <br />RE: Lily Mines; Permit No. M-1987- 28 <br />Notice of Possible Violation; Wildlife ~/ <br />Dear Mr. Addison, <br />The Division of Minerals and Geology informed Colorado Marble, L.L.C. of a possible violation of <br />C.R.S. 34-32.5-116(1) of the Colorado Land Reclamation Act I'or the Extraction of Construction <br />Materials for failure to perform the reclamafion prescribed by the mining and reclamation plan. <br />Specifically for not complying with Stipulation No. 1 for operations to only occur between the months of <br />June to September. In addition, a possible violation of Rule 3.1.8 for failure to take into account the <br />safety and protection ofwildlife on the mine site with special attention given to critical periods in the life <br />cycle of the species which requires special consideration as specified by the Division of Wildlife. <br />Upon further review, the Division will not proceed with this matter as a possible violation. Instead, the <br />Division will require the operator to inform the Division of the date in which operations cease for a given <br />yeaz. Please be reminded that operations at the site are to occur between the months of June to <br />September.
