E., Pioneer Engintxring <br />Henry Austin, Office of Surface Mining (OSM) <br />I conducted the above inspection on September 22, 2000, from 9:00 am to 2:30 pm at the Jim 8c <br />Ann Tatum occupied residential dwelling know as Solitario. The inspection date and time was <br />requested by Ms. Tatum in order for her consulting engineer, Mr. Geriry, to be present during the <br />inspection. Ms. Johnson paRicipated in the inspection ropresenting the CCC. This partial <br />follow-up inspection was required by an Interior Soazd of Land Appeals (IDEA) order dated July <br />26, 2000, which denied an OSM petition far reconsideration of the IBLA's January 5, 2000, <br />decision regazding IBLA 96-90 end iBLA 96-91. These cases aze two appeals of decisions made <br />by the OSM Western Regional Coordinating Center (VVRCC) Regional Director. The Tatum's <br />filed the appeals with IBLA with respect to the WRCC Regional Director's decisions regarding <br />the Erna] disposition of citizen complaint No. CC-93-020-008. This inspection was required by <br />the above IBLA decision to cite a violazion of Colorado / DMG Rule 4.20.3(2) relating to <br />subsidence damage to ttlc above occupied resldentia] dwelling. Thls was the only focus of the <br />partial inspection. <br />We began the inspection wish a getleral discussion of the subsidence damage to the home. Ms. <br />Tatum primarily described the continuing cracking of the outside stucco finish, interior wall . <br />finish cracking /pealing /blistering, aad signs of instahiliry exhibited by what appears to be <br />displacement /movement between finished interior wall surfaces and ceiling vigas and flooring. <br />We toured the inside of the dwelling as Ms. Tatum described the damage. Subsidence damage to <br />the home was initially addressed by what Ms. Tatum characterized as cosmetic repairs (repairs) <br />during 1996 and 1997. T1te damages described above and photographed during this inspection <br />have occurred since the repairs. Four damaged areas photographed were not evident to the <br />inspection participants prior to the repairs, and will be noted later in this report. The otily other <br />potential subsidence damage described by participants, not related to the dwelling, is what <br />appears to be a water saturated land surface in the pasturC south of the raeidence driveway area <br />and fence. Ms. Tatum indicated she believes the Trinidad City water line from North Lakc to <br />Trinidad vaverses the pasture in this area. <br />
