Long <br />Division Dneclor <br />Mike Altavilla faxed me a letter outlining their comments/concerns regarding NOV C-96- <br />017. The NOV was issued to Seneca Coal Co. on August 30, 1996. In summary, Seneca is <br />modifying Routt County Road 27 and 27a to allow a 60' wide passage for the dragline to <br />walk from the Seneca II mine to the Yoast Mine. On the cut slope of Routt County Road <br />27a, Seneca disturbed an additional 20' wide, 25'-30' high and 1000' long along the length <br />of the road. This material is being place along Routt County Road 27, just prior to entrance <br />of the mine area. The NOV was issued for; failure to conduct mining operation within the <br />permit area along Routt County Road 27a, implementing a revision prior to approval, <br />failure to provide specification and geotechnical analysis on the road cut and failure to <br />provide a reclamation plan for the road cut. <br />In Seneca's letter, all of our names were mentioned regarding Routt County Road 27a. This <br />is the road that leads into the Seneca II Mine Office area. The operator basically contends <br />that the anticipated disturbance was mentioned to all of us on numerous occasions in order <br />to walk the dragline. I have spoken with each of you individually regarding these <br />conversations, and it appears to differ from what the operator has stated in the letter. <br />Please read over the attached letter, and provide me comments regarding your recolection <br />of conversations with the operator regarding the "dead head" route or modifications of <br />County Road 27a. Your comments will go into the NOV file and may possibly be used <br />during the assessment conference.
