Long <br />Division Diretlor <br />We have received from The Pittsburg & Midway Coal Mining Company (P&M), a request for <br />an extension of the abatement deadlines for the above mentioned notices of violations. A <br />copy of that request has been provided for your review. Notice of Violation C-93-025 was <br />written for failure to provide designs for existing drainage control structures at the Edna Mine, <br />and was issued on April 5, 1993. Notice of Violation C-93-026, also issued on April 5, cited <br />a failure to retain sediment within disturbed area boundaries. The deadline for abatement of <br />the violations was set for July 4, 1993, the maximum time permitted by Rule 5.03.2(2)(b). The <br />abatement requirements consisted of two steps: 1) submit technical revisions to include the <br />required designs and revised drainage plans, and 2) implement the plan within two weeks of <br />Division approval. Due dates for these actions were May 20, 1993, and July 4, 1993. P&M <br />submitted two technical revisions on May 17, 1993 and May 20, 1993, respectively. The <br />Division has not yet completed an adequacy review of the submittals. <br />P&M would like an extension of 60 days on the abatement deadlines, to September 2, 1993. <br />I believe this is a reasonable request which complies with Rule 5.03.2(2)(c)(i), since the <br />operator has applied for technical revisions in a timely fashion. Therefore, I am requesting <br />that you authorize such an extension. <br />SLM\070293B. WP <br />
