with all federal, state, and local laws, regulations and standards relating to air, <br />water, land and noise pollution. <br />j. The permittee shall not permit the storage of or spill any toxic or hazardous <br />material on this site while in its possession. No underground storage facilities are <br />authorized. The Permittee shall be responsible for the clean-up or restoration of <br />this land due to any tonic or hazardous material during its occupancy of this site. <br />k. No salable minerals, such as sand, gravel or stone, found on the permit land, shall <br />be removed or used by the permittee unless purchased from the State Boazd of <br />Land Commissioners. <br />1. Where practicable, existing roads shall be used. This permit does not allow <br />vehicular use off of the designated area, except for essential ingress and egress to <br />and from the permit area. All gates shall be left open or closed, as found. <br />m. This permit is issued for the purpose specified above and no other. Should the <br />permittee use or attempt to use the described land for any other purpose including <br />but not limited [o the storage, crushing, or processing of any materials taken from <br />any properties except those included under Quarry Lease QR 3332, without written <br />permission from the Board of Land Commissioners, the permission herein granted <br />shall immediately terminate. <br />n. The State Land Board reserves the right to terminate this permit at any time upon <br />thirty (30) days' notice in the event of the sale, exchange, condemnation or any <br />other disposition of the leased premises. In such event the permittee shall only be <br />entitled to be compensated for the value of its permanent improvements placed on <br />the leased property and approved in writing by the State Land Board. In,no event <br />shall the State Land Board be liable for the payment of any such compensation to <br />permittee. Permittee shat( not be entitled to receive any compensation for any <br />value of its leasehold interest. <br />o. If this lease terminates for any reason, Lessee shall have no claim or right to any <br />compensation for any lease option beyond the months of this lease, or for any <br />expectation that the lease term would be extended or the lease renewed. <br />4. 'flee permittee shall be liable for the reclamation of any damage caused by the issuance of <br />this pettuit and shall ensure that said reclamation is included in any bond as may be <br />required by the Division of Minerals and Geology pursuant to General Quarry Lease QR <br />3332. <br />That no assignment of this permit shall be valid unless it shall have been entered upon <br />records of and approved by the State Board of Land Commissioners and payment of <br />assignment consideration made. Any unapproved assignment of this permit shall in no <br />way release the permittee from liability to the grantor. It shall be understood by the <br />Lessee that any name change of the permittee shall be deemed as an assignment and <br />approval of such name change must be obtained by the Lessor, but such approval may <br />not be unreasonably withheld. <br />6. Subleasing all or any part of the permitted premises for any purpose during any part of <br />the term of the permit unless authorized by the State Board of Land Commissioners in <br />writing, shall be cause for cancellation at any time. <br />7.
