ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Petitioner's appeal of the <br />Division's decision denying Petitioner's acreage release request is hereby granted and the <br />designated 220-acre parcel known as Cell #1 (as depicted in Exhibit A hereto, and not <br />including the land bridge) is hereby released from the Petitioner's mined Iand reclamation <br />permit, M-1987-049, provided the Board f rst receives: (1) a signed copy of the,4greenzent to <br />Facilitate the Development of a Water Storage Facility in Cell #1 at Bromley Lakes, n/k1a <br />Mitchell Lakes, that is substantially similaz to the Draft Agreement and which explicitly <br />incorporates the minimum reclamation standards required by the State; and (2) a letter from the <br />City releasing the State from any liability for remaining reclamation, explicitly agreeing to <br />abide by the minimum reclamation standazds required by the State, and confirming ownership <br />of Cell #1. <br />Imo. n / <br />DATED this ~ day of ~~hs .~ Ll~ , 2005. <br />FOR THE COLORADO MINED LAND RECLAMATION BOARD <br />~~ <br />l ~1 ~C~.- ~'. <br />Michael T.
