<br />Mr. Robert Hagen - 2 - August 26, 1991 <br />The Ten-Day Notice was written for numerous hydrologic concerns. Part 1 of <br />the TDN was abated by submittal of Small Area Exemption demonstrations. This <br />was a permitting exercise which resulted in little, if any, on-the-ground <br />changes. Part 2 of the TDN was abated by submittal of a revision addressing <br />installation of a water treatment facility upon resumption of active mining, <br />which was the source of the concern. The operator has not installed the <br />facility as the mine has been idle since the revision was approved. The OSM <br />visit is scheduled for four days. This length of time indicates that the <br />scope of the visit has been broadly expanded beyond OSM's stated purpose. <br />As with the Edna visit, we do not believe that there is any basis for the Coal <br />Basin visit. If, however, you elect to proceed with the visit, we must insist <br />that it be limited to the issues raised in the November, 1990 TDN. <br />Colorado works diligently to resolve minesite issues within the latitude <br />afforded by the Act and the Rules. The issues of inadequate notification and <br />improper access to sites is jeopardizing our ability to ensure compliance and <br />our ability to resolve key policy issues facing this program. It is incumbent <br />upon our offices to resolve these problems and their impacts to the Colorado <br />program.
