Further, to access this isolated area one would have to cross <br />the perimeter fence, traverse the tracks, then cross additional <br />permit area to reach the unpermitted area. We do not agree that <br />the absence of signs on this area would constitute an obstruction <br />to enforcement within the permitted area nor would a lack of signs <br />affect our ability to protect the environment or provide for the <br />public's safety. We, therefore, do not believe the absence of <br />internal markers violates the performance standards in Rule 4.03.3 <br />and does not warrant a violation. <br />We recognize that the NOV was issued in response to OSMRE <br />activities. The Technical Revision to change the permit area <br />delineation on the appropriate map was submitted to clear up the <br />apparent confusion on OSMRE's part. <br />Nevertheless, we maintain that we have complied with the MLRD <br />rules and the NOV is clearly not valid in this case. <br />Sincerely, <br />~~~ <br />J es A.
