~ iini~iii <br />«i ii~ii <br />~. ~~ ii <br /> : <br />MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE <br />DIVISION OF MINERALS & GEOLOGY, DEPARTMENT OF NATURAL RESOURCES <br />AND THE <br />WATER QUALITX CONTROL DIVISION, COLORADO DEPARTMENT OF HEALTH <br />RELATIVE TO <br />WATER QUALITY MANAGEMENT AT COAL MINES <br />PURPOSE <br />The purpose of this riemorandum of Understanding (HOU) is to define the respective <br />responsibilities of the Division of Hinerale and Geology (DHG) of the Colorado <br />Department of Natural Resources and the Water Quality Control Division (WQCD) o£ the <br />Colorado Department of Health regarding coal mining activities as they impact the <br />hydrologic balance. The purpose of this HOII also is to: <br />1. Ensure that appropriate corrective actions are applied so as to minimize the <br />period of non-compliant discharge; <br />2. Provide protection of the State's water resources by ensuring that non- <br />compliant dischargers are appropriately cited in a timely manner and do not <br />receive an economic benefit over other facilities as a result of non- <br />compliance; <br />3. Coordinate enforcement actions so ae to minimize dual enforcement to the <br />extent possible, while maintaining the integrity of the programs implemented <br />by each Division; <br />4. Foster enhanced communications and working relationships between the two <br />- Divisions. <br />UNDERSTANDING BETWEEN THE PARTIES <br />This HOU is entered into by the DMG of the Colorado Department of Natural Resources <br />and the WQCD of the Colorado Department of Health, (the parties) and may be modified <br />by written concurrence of both parties. <br />This MOU replaces the previous MOU which was entered by the parties on January 2l, <br />1985. <br />Nothing in. this HOU shall be construed to preempt or alter the statutory or <br />regulatory responsibilities and authorities of eitheY party. <br />This HOU shall be effective until such time ae either party decides to terminate the <br />agreement. <br />This HOU is entered this ~ day of Pebr~u"a'ry, 1994. <br />Patricia A.
