December 22, 1989
Mr. Fred Banta
Director
Mined Land Reclamation Board
Dept. of Natural Resources
1313 Sherman Street, Rm 215
Denver, CO 80203-2273
~II'I~~I~~I~~~~~ ~I~
ass
~~~~ rr..
., .
GE ~ y~®
AF~~M TO~~~~9
Oi~,o.
~~ 7~ f
Re: Party Status at MLRB Hearing on Amended Permit Application for
Battle Mountain Resources Inc.
Dear Mr. Banta:
This letter is to advise you of the fact that both Lynn and Jane
Kircher wish to have party status in the MLRB proceedings in the
matter of Battle Mountain Resources, File No.-M-88-112.
We feel that we are entitled to be admitted for the following
reasons.
1. We own property in the San Luis Valley.
2. We have been associated with the community and its
chosen course of economic development using the arts for over 3 years
now.
3. We have participated in numerous discussions, have
reviewed Battle Mountain's permit amendment application. We have
serious concerns in the following areas, all of which are impacted by
this application, among which:
a. The community of San Luis being on the National Historic
Register falls under the "line-oP-sight" rule; impacted Foy
clearly visible tailings pile.
b. Long-term economic development of the community as an
artistic and cultural community in the Santa Fe and Tacos
corridor. Which direction is directly in harmony with
historical and community chosen direction. The community
impacted by this project will derive few if any benefits and
only long-term liabilities.
c. Air pollution caused by Dore furnace and dust from
operations and tailings.
d. Threat to avian wildlife of containment ponds.
e. Long-term continuing threat to wildlife and humans from
tailings drainage.
