Walther <br />Executive Director <br />Michxl 8. long <br />Division oireclm <br />On March 1 2, 2002, DMG received a Technical Revision to the Amendment application (AM-01) <br />for the Thomas Pit. Within that correspondence, dated March 11, 2002, Mr. Lewicki inquired <br />about a potential decision date for the river protection items, earlier than the current decision date <br />of May 16, 2002. <br />Pursuant to Rule 1 .4.8, DMG may make a decision on some types of 1 1 2c applications, which <br />have not received objections, earlier that the 90"' day of the application. However, should the <br />1 1 2c application receive objections, DMG cannot make a decision sooner than 30 days following <br />the close of the public comment period, as required by Rule 1.4.9. <br />Copy of the public notice required under Rule 1.6.211)(d) and (e), provided by the applicant, <br />indicate the close of the public comment period to be April 8, 2002. Therefore, providing DMG <br />does not receive timely objection to AM-01, the earliest possible date on which DMG could issue <br />a decision for any aspect of AM-01 would be April 9, 2002. However, should DMG receive <br />timely objection to AM-01, the earliest possible date on which DMG could issue a decision for any <br />aspect of AM-01 would be May 9, 2002. <br />The April 9, 2002 and May 9, 2002 dates are provided in response to Mr. Lewicki's inquiry and <br />do not indicate a commitment by DMG to make any decision prior to the statutory 90 day <br />deadline, May 16, 2002. <br />DMG is reviewing AM-01 and its two recent revisions.
