C-85-047, Mine No. 3, Permit No. C-84-062 <br />Dear Mr. Mathews: <br />Colorado Yampa Coal Company (CYCC) is submitting the following informa- <br />tion concerning the above referenced alleged violation which was issued to <br />CYCC on May 24, 1985. The alleged violation was issued for "failure to pro- <br />perly maintain sedimentation treatment facilities. Specifically, the small <br />area exemption collection ditch and gravel filter sediment trap at the Middle <br />Creek office/shop area were totally silted in and non-functional." <br />The collection ditch and gravel filter trap were cleaned out and repaired <br />by Thursday, May 30th. This maintenance was performed as a necessary step to <br />abate the alleged N.O.V. and was required to be completed by June 1, 1985. <br />Attached is a map titled "Mine 3 Sedimentation Treatment Facility and <br />Small Area Exemption". The map shows the location of the collection ditch <br />within the small area exemption and the location of the filter sediment trap. <br />On May 23rd, CYCC's Lead Surveyor went to Mine 3 and surveyed in the <br />location of the collection ditch. The survey stakes were noted by the CMLRD <br />on May 24th. A grader and backhoe were temporarily relieved of their normal <br />activities and were dispatched to Mine 3 on Wednesday, May 29th to begin work <br />on the ditch. The ditch and sediment trap were completed on May 30th. <br />CYCC agrees that the sedimentation treatment facility was not functional, <br />but contends that other factors as described above should be evaluated in <br />accessing the severity and seriousness of the alleged violation. <br />Sincerely, <br />~w9,<,,.5~ lan <br />Richard Hughes <br />Environmental Specialist <br />RH:kmk <br />cc: G.
