Per my telephone conversation with you today, I am providing the following response in an effort to cause the violation cited to be corrected: 1. During the joint DMG/OSM inspection of April 12-16, 1993 at the New Elk Mine, it was discovered that the access road approved in 1990 for the refuse disposal area was identified on the permit map as existing in part outside of the mine's approved surface disturbance area and permit area boundaries. 2. On April 19, 1993 the Division notified Basin Resources, Inc. of this permit defect, and required them to submit by May 3, 1993 a Minor Revision to Perntit No. C-81-012, to correct the map to include all portions of the RDA access road within the New Elk Mine surface disturbance area and permit area (copy of letter enclosed). 3. On May 3, 1993, representatives for Basin Resources, Inc. met with the Division on a number of enforcement related issues, but failed to bring to the meeting the RDA access road Minor Revision. The operator verbally requested a one day extension for submittal of the Minor Revision, to May 4, 1993. The Division granted this verbal request on the condition that a written request for the extension, along with the Minor Revision, be submitted to the Division by May 4, 1993.
