4. The applicant states that Accessory Building will be retained for the use as a boathouse as <br /> part of the postmining land use. The operator will need to submit the following in order to <br /> leave any mining related structure in place as part of the postmining land use; <br /> • A letter from Weld County that states the Accessory Building may be left in place and <br /> meets the Weld County zoning requirements for the approved postmining land use, and <br /> • A notarized letter from the landowner requesting that the Accessory Building remain in <br /> place to achieve the end land use. <br /> 5. The mine plan states that the mining excavation will have a set back of 100 feet from the <br /> boundary of the St Vrain River. The revised map depicts the edge of excavation closer than <br /> 100 feet to the River. Technical Revision 002 (TR-002) approved by the Division on <br /> October 21, 1998, specifically addresses armoring the banks of the river, changing the seed <br /> mixture and planting desirable trees. The shoreline mitigation plan required by The Army <br /> Corps of Engineers was incorporated into the Bailey Pit reclamation plan for the previously <br /> mined area of Lake 41. Please clarify if the remaining mining area will maintain the 100-foot <br /> set back distance. If the operator intends to mine closer than 100 fleet to the River on the <br /> remaining area, then a streambank mitigation plan will need to be incorporated into the <br /> permit. <br /> 6. Doug Tiefel of Goose Haven Sand & Gravel, Inc. waived their right to a 30-day processing <br /> time for the Transfer of Permit and Succession of Operators (SO-003) received by the <br /> Division on March 23, 2000. The Division will approve SO-003 once the operator has <br /> addressed the above noted items and the reclamation bond has been calculated. <br /> The Division's decision due date for this technical revision is April 26, 2000. Please respond to <br /> these concerns prior to this date.
