PAGE 4 <br />event. The probability of a storm of this magnitude occurring ie <br />less than once in ten years. Although the capacity was reduced on <br />the ditches and culverts, any additional flow which would occur <br />would still report to sediment ponds. These structures were <br />designed per regulation, to handle capacities from storm events up <br />to a 10 year/24 hour. The design event was surpassed. All <br />structures. except, two. culverts were returned to their design <br />capacities-prior to departure of the inspection team on August 12. <br />Clean-out of the other two culyerts.was done before the abatement <br />deadline. •Seriousness is extremely-low due to the nature of the <br />event that caused the problems, short diiration;!and limited•acttial <br />and potential damage which may have occurred. <br />FAULT: The unavoidable nature of the storm event, combined <br />with the very quick response time to correct the identified areas <br />indicate a very low fault value. Response time was delayed because <br />of the extremely wet conditions and the labor'diapute which did not <br />allow a continuation of cleanup. Cleanup of, the drainage system <br />was. well underway at .the time of inspection. It continued <br />throughout.. the .inspection. .The .cleanup was progressing 'in a <br />priority fashion with these secondary structures awaiting their <br />turn:' The failure to maintain was a direct result of~the .total <br />disruption of. the drainage system cauaed,by the storm.. <br />GOOD''FAITS: All but .two culverts were completely, cleaned <br />prior. to. departure of the inspection team., All ditches were <br />returned to design capacity. Completion of the clean out of the <br />.two r2maining culverts was done by August 13 for one and August.l7 <br />for the second. Both were finished within the abatement deadline <br />date. Repair work wag well underway. upon your 'arrival, all <br />ditches and most culverts returned to design capacity, and the two <br />remaining culverts partially•reatored prior to` inspection team. <br />departure: .Good faith .credit should be at the maximum. ~ . <br />NOV C-94-020: Failure to Maintain Pond Primary. .Spillway <br />Structures. <br />SERIOUSNESS: The extent of actual or potential damage caused <br />by this NOV is extremely Iow. The primary spillway for ,pond '008 <br />had a leaking riser. This riser has never leaked prior to the . <br />major, storm event because the water level in the pond has never <br />been .up that height. The increased water elevation was caused by ' <br />the major.atorm. 'The"amount of water leaking is minimal. _The <br />water is absorbed into the ground prior to reaching the -CDPS <br />sampling location. In. other words, there was no regulated <br />discharge. The gate valve leak at .pond 007 was also dripping a <br /> <br />
