Long <br />Division Director <br />Re: Del Norte West Valley Pit, Permit M-2001-069, Approval of Technical Revision TR-01 Allowing <br />Additional Staging Area, Revised Financial Warranty Estimate. <br />Dear Mr, Stockebrand, <br />I have concluded my review of the above-named request for technical revision. The proposed change was well <br />explained in your technical revision submittal. There are couple points I feel should be discussed at this time, even <br />though I am approving the revision. <br />(1) The timeframe for how long the 6.92 acres is to be used as an additional staging azea is not specified in <br />your proposal. Whether this area remains in use for a long or short time is not terribly important, as long as <br />activities carried out are limited to those approved in this revision, it is maintained in a stable condition, and the <br />added amount of posted bond remains sufficient to reclaim disturbances. Reclarnation of the site will become more <br />difficult if the site is left neglected and tuv'eclaimed, so I encourage you to ensure it is reclaimed in a timely manner <br />when operations there are through. (Once it is reclaimed, you may request that the bond be reduced accordingly, <br />pursuant to Rule 4.16. Until such time, however, it will be treated the same as other bonded disturbances in the <br />permit area aze treated.) <br />(2) The revision includes the placement of an aphalt batch plant on the site during certain times. I have <br />assumed that the plant components aze all portable and no permanent structures will be constructed. Please confirm <br />this aspect of the plan. <br />(3) Batching equipment will requue a power source, and I have assumed that diesel storage may be required at <br />the site. It will be important to provide for adequate storage of all fluids (such as diesel, hydraulic, oil, antifreeze, <br />for example) which pose a risk of contamination to soil or groundwater. This includes a bermed area with an <br />impermeable liner, of sufficient capacity to contain all fluids. This storage facility may be within the original <br />processing and stockpiling area or in the new 6.92-acre staging area. Please commit to providing such storage. <br />Finally, I have enclosed a bond estimate for the added costs of reclaiming the additional 6.92 acres of staging area. <br />I appreciate the figures you included in your proposal. My estimate came in at $8,132, slightly less than your <br />amount. This additional amount must be submitted and found acceptable by our Denver bonding staffbefore the <br />technical revision is fully approved. <br />Please review the enclosed figures and notify me promptly (see address below) if you notice any errors or <br />omissions.
