It appears that the construction of a slurry wall will cross agas/oil line and the Last Chance Ditch on <br />the property between Phase III and N. The operator will need to demonstrate that the gas/oil lines <br />and ditch will be stable with the construction of the proposed slurry walls in the form of an <br />engineering evaluation, or provide a notarized agreement between the owners of the structures and <br />Weld County that meets the requirements of Rule 6.4.19 and Section 34-32.5-115(4)(e), C.R.S. <br />Please be awaze that if the gas/oil line or ditch needs to be modified or relocated as a result of the <br />mining and reclamation operation, then a notarized agreement between the operator and the owner of <br />the structure must be obtained prior to approval of the application. <br />Under Rule 3.2(7) the Division is required to conduct an inspection prior to Board consideration. The <br />Division will schedule an inspection prior to the decision date. Additional questions may arise as a <br />result of the inspection. <br />Please be advised that the Hokestra Pit AM-03Application may be deemed inadequate, and the <br />application may be denied on January 3, 2007 unless the above-mentioned adequacy review items are <br />addressed to the satisfaction of the Division. If you feel more time is needed to complete your reply, the <br />Division can grant an extension to the decision date. This will be done upon receipt of a written waiver <br />of your right to a decision by January 3, 2007 and request for additional time.
