Everist, Inc., Fort Lupton Sand and Gravel Mine, DMG #M-1999-120; <br />Second Adequacy Response Letter <br />Please note that the existing Fort Lupton pit operated through the summer of 2004, which was <br />an average precipitation year following a series of drought years, without any significant effects <br />to the hydrologic balance or complaints received. Likewise, we are not aware of any known <br />problems to the hydrologic balance caused by other permitted pits with slurry walls along the <br />river northeast of Denver. <br />Exhibit H -Wildlife Information <br />16. Wildlife - 200-foot setback from river <br />Thank you, we will maintain a 200-foot setback from the river. <br />Exhibit L -Reclamation Costs <br />17. Reclamation Costs in phases <br />Thank you, we will bond in phases, submitting a TR prior to each phase. <br />We hope that with LGE's additional commitments in this adequacy response, that LGE has <br />addressed all of the Division's concerns, and that the Division can recommend approval. If we <br />have not addressed all of the Division's concerns, please call me right away at 303-286-2247 <br />(office) or 303-514-2778 (cell), and we can work together to come to a solution. <br />To allow the Division adequate time to review this response, as we discussed at the January <br />19`" meeting, we request an extension until January 26, 2005, so that we can hopefully still have <br />our pre-hearing conference on January 28, 2005. If additional time is required, please let me <br />know at one of the phone numbers listed above.
