Similar issues were addressed at a December 15, 1993, hearing before the Colorado Land Reclamation Board. I am enclosing for your review a copy of "Request for Party Status and. Exhibits" presented at this hearing on behalf of Raton West - Baldwin Ltd. Development. While much of this information in this package does not apply to our complaints, some of it is relevant. Enclosed is a copy of the October 26, 1993, memos.from Steven Renner to Michael Lohg. Zn total, 26 Notices of Violations were issued to Basin. Renner states "The Division believes that these Notices of Violations and one Imminent Harm Cessation Order .do nat represent isolated departures from lawful conduct, but rather a broad, overall lack.' of concern with regulatory. compliance by .the- permittee." "The Division. further believes. these =:iolatiors ~c;ere caused by the unwarranted failure. of the permittee to comply with the requirements of the .Act, Rules .and permit .conditions. Therefore, I recommend that you concur. with the staff determination that a Pattern of Violations exists at this mine." The mine did not. secure a Las' Animas County building permit for the exhaust shaft on our property until 6 - 12 months after-the installation .was installed and until the mine vas threatened: by the Las Animas County Planner's office. While I understand that this violation of the law is not under the jurisdiction of the Division, it does display the minus basic total disregard for the law and the rules. What assurance do we have that the information the mine provided. .us with regard to the distance from our home to the ^First Mine^ is correct~~ We were first told the mine was 750 feet from our home, then later advised they were 200 to 30o plus .feet from our home. we know that the
