The East Taylor Creek pond was designed and constructed in the fall of 1995. During the <br />permitting process, the Division questioned the operator if pit pumpage would be necessary <br />into the East Taylor Creek Pond. The operator sated that no pit pumping would take place <br />from the West Pit, and therefore, was not included in the design of the pond. <br />Over the year, the Division and Colowyo have had several discussions regarding pit <br />pumpage into sediment ponds. The Division has informed Colowyo numerous times that <br />any pit pumpage must be incorporated into the design of sediment ponds. This issue was <br />raised last year when pit water was pumped into the West Pit Pond. The designs of the <br />West Pit Pond were reviewed, and revealed that the pond could handle a moderate amount <br />of water pumped from the West Pit. <br />The Division and Colowyo met February 5, 1996 regarding Midterm review issues. At this <br />meeting Colowyo implied that no pit pumping would take place from the West Pit. The <br />Division met again with Colowyo and Water Quality Control Division on February 28, 1996. <br />At this meeting, Colowyo again stated that no pit pumping would occur at the Colowyo <br />mine. <br />In summary, the East Taylor Creek Pond was not designed to contain or treat the water <br />being pumped in from the West Pit. The Division has informed Colowyo on numerous <br />occasions that any pit pumpage must be incorporated into the design of the sediment pond. <br />Colowyo's only response was that no pit pumping would occur at the mine.
