<br />June 9, 1994 <br />Page 2 <br />with the reclamation requirements, Mr. and Mrs. Guffey will seek damages against Ms. <br />Abbott as a result thereof. <br />C.R.S. 34-32-119 contemplates that the successor operator shall assume all <br />liability for the reclamation of the affected land. Under no circumstances have Mr. and <br />Mrs. Guffey ever agreed to do so, nor for that matter did they have any knowledge <br />of the extent of damage caused by Ms. Abbott to the property until receipt of the <br />report from the Mined Land Reclamation Division. You may also verify with the Mined <br />Land Reclamation Division that transfer of the permit will not be authorized until Ms. <br />Abbott either complies with the reclamation requirements or meets the additional <br />bonding requirements that have been imposed. By copy of this letter, l am advising <br />the staff of the Mined Land Reclamation Division that Mr. and iVlrs. Guffey do not <br />assume Ms. Abbott's responsibility for reclamation but rather insist that Ms. Abbott <br />immediately comp/y with the requirements as set forth in the report. <br />1 am hopeful that current events will not lead to further litigation between the <br />Guffeys and Abbott however, we feel that decision ultimately rests with Ms. Abbott <br />and her decision with respect to compliance with the reclamation requirements. <br />if you would like to discuss this matter in greater detail, please do not hesitate <br />to call me. <br />Sincerely yours, <br />J.
