This request is precipitated by the inaccessibility of the NW Sediment trap <br />due to deep snow conditions and saturated material conditions in the trap. Sun Coal believes <br />this request is allowed by Rule 5.03.2(c)(iv) which states in part, [circumstances which may <br />qualify a surface coal mining operation for an abatement period of more than 90 days] "where <br />climatic conditions preclude abatement within 40 days, or where, due to climatic conditions, <br />abatement within 90 days clearly would cause more environmental harm than it would <br />prevent."
