4. Cm the Application Form, the notary signature must state the con•ect company name. This line was <br />left blank. <br />5. Cm the Application Form under the notarized signature, James S. Miner is listed as "Provider" <br />whereas the other areas of the application form state "President". Please clarify this discrepancy and <br />revise the form accordingly. <br />6. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or <br />other qualified person. The maps submitted to the Division were not signed. Please resubmit a <br />signed copy of the maps. <br />7. Rule 6.4.3 Exhibit C- Pre-Minin¢ and Mining Plan Mao(sl of Affected Land Please address the <br />following items on the map; <br />• Please provide the existing topography of the proposed mine area with contour lines of sufficient <br />detail to portray the direction and rate of slope of the affected land. <br />• The map does not show a buffer azea between the River and the mining operations as described in <br />other sections of the application. Please indicate the location and extent of the buffer azea. <br />8. Rule 6.4.5 Exhibit E- Reclamation Plan Please address the following items; <br />• For azeas that will not be reclaimed to industrial end land use (i.e. slopes), please provide a <br />revegetation plan that list the preferred species of grass, legumes, forbs, shrubs or trees to be <br />planted, the method and rate of seeding and planting. This should also include provisions for <br />saving and utilizing topsoil and an anticipated depth of topsoil to be replaced. <br />• Please provide a method of weed control that shall be employed for all prohibited noxious weed <br />species, and whenever invasion of a reclaimed area by other weed species seriously threatens the <br />development of the desired vegetation. <br />9. Rule 6.4.6 Exhibit F- Reclamation Plan Man Please address the following items; <br />• The map must show proposed topography of the area with contour lines of sufficient detail to <br />portray the direction and rate of slope of all reclaimed lands. <br />• Please portray the final end land use for each portion of the affected lands. <br />10. Rule 6.4.7 Exhibit G- Water Information The following items still need to be addressed; <br />• Please provide a descripfion of specific actions that the Applicant will take to minimize <br />significant impacts to the prevailing hydrology of the azea. These could include such things and <br />providing a buffer between mining and the River, not mining in the River channel, devising a <br />system to safely pass flood water through the mine operation, and reclaiming the mine area to <br />floodplain. <br />• Please depict the wetlattd azea on the maps and submit the revised map to the Division. <br />11. Rule 6.4.19 Exhibit S- Permanent Man-Made Structures <br />Based on the Division's adequacy letter dated November 6, 2006, it appears that State Highway 52, <br />the access road and two power lines are within 200' of the affected mining area.
