Cattany <br />Division Director <br />Division of Minerals and Geology <br />January 13, 2004 <br />Page 2 <br />It is unfortunate that the January 5`h notice was sent, as I believe steps can and will be <br />taken to remedy the reclamation issues which have been brought to our attention. Those steps <br />will be discussed in more detail with your staff at a meeting which is scheduled for Thursday, <br />January 15, 2004. At that time we hope to be able to develop a plan to submit the necessary <br />applications and amendments which will satisfy the Division's requirements. <br />Your letter explains that a Formal Public Hearing will be scheduled for the February <br />Mined Land Reclamation Board meeting. At the January 5 meeting, we were informed that the <br />Mined Land Reclamation Board will meet January 20 and 21. Rather than wait, I would like an <br />opportunity to appear at the January meeting to discuss the steps that Denver Water is taking to <br />address the issues raised by your staff and to explain why we do not believe that a violation has <br />occurred. <br />Please let me know whether an appearance is appropriate and the day and approximate <br />time this matter will be on the Board's agenda.
