The land is part of <br />a ranch owned by Mr. Doyle Russell. He said that the pit has been <br />operated off and on probably for the past 70 years and the product <br />is used by ranchers, the county and local municipalities. Mr. <br />Russell said the sand and gravel is excavated by a contractor. <br />On-site disturbance included a pit approximately 2 acres in size <br />and an additional 2.5 acres where the topsoil has been stripped <br />and stockpiled in preparation for mining. On-site equipment <br />included screening equipment in the pit and a scraper and dozer. <br />Total disturbance directly related to the operation is <br />approximately 4.5 acres. <br />Seriousness: Zones <br />0-2 Acres 2.1-9.9 Acres S0+ Acres <br />$3,000 $9,000 $60,000 <br />History of Violations in Past Twelve Months: None <br />Staff Recommendation: <br />Violation: Find a violation of C.R.S. 34-32-109(2) <br />for mining without a permit. <br />Cease and Desist: Recommended for the areas disturbed by <br />the mining operation. <br />Corrective Actions: Submit a complete application no later <br />than November 21, 1994 and obtain an <br />approved permit from the Division within <br />30 days of submittal if it is a 110 <br />permit or within 90 days of submittal if <br />it is a 112 permit. <br />Civil Penalty: $9,000 recommended based on 2.1 to 9.9 <br />acres of disturbance. <br />
