Morris and A»deraon: ` ~ <br />Notice of Violation CV-2000-009 is hett~by vacated without prejudice. This Notice of <br />Violation is vacated in accordance with the request of Mr. Wa]ton D. Morris. Counsel for <br />]im end Ann T'etutn, ooaveyed by a letter dated Meroh 8, 2001. As specified la the letter <br />of March 8.2001, the citizen ootnpleint prevlotaly submitted by Aon Tatum, regarding <br />ctareat subsidence damage to the residence house at Solitario Ranch, has beeawitbdrawn ~ ~.' <br />by Amt Tatum without prejudice. The Tattlms have chosen to pursue thou claims against <br />Basin Resources, Inc, through judicial process, as authorizal by applicable provisions of <br />the Colorado Surface Coal Mining Rechtulation Act, 34-33-135, C.R.9. ~ Y <br />Notice of Violation CV-2000-009 was issued on November ], 2000 in response to the `'h; Y <br />citlman coaplaint filed by Ann Tatum, and was substantially based upon the statenlmts ~ ;•' <br />amd evidence provided in the citizen complaint. The citizen complaint has now been <br />withdrawn, end the complaining citizen has requested that the Division of Minerals and <br />Geology vacate the Notice of Violation CV-2000.009. The Division of Minerals and <br />Geology avill mt ptuaue this violation against Basin Resources. Inc. without the cvidenae <br />and sretemetm previously provided by Ana Tatum, r~egerdiag the damage w the private <br />Tatum residetce and property.
