PCC objected to the statement that proper mine planning should <br />have prevented this occurrence. PCC reiterated that during the <br />mine planning this location was chosen because there were no <br />signs of instability, it was close to the pit and would eliminate <br />the need for double hauling. <br />Based on the information presented in the conference, I am <br />proposing to reduce this to $500.00. <br />Good Faith <br />PCC immediately reassigned equipment and crews to backfill and <br />stabilize the pit area and highwall below the topsoil stockpile. <br />In the process approximately 20,000 tons of coal were covered. <br />This coal will have to be uncovered or lost when they reenter the <br />area. They have modified the mine plan to avoid this area until <br />the topsoil is replaced on reclaimed areas. PCC submitted a <br />summary of their costs to abate the NOV. they were $63,866. I <br />believe their efforts represent extraordinary effort and it was <br />done i the shortest time possible.
