BY TELECOPY (303-866-3558] <br />First Assistant Attorney General AND U.S. MAIL <br />Natural Resources & Environment Section <br />1525 Sherman Street, Fl. 5 <br />Denver, CO 80203 <br />Re: Pathfinder PitlSan Miguel County/Public Service Companv of Colorado <br />Concerns Re: SIo Tie Stability and Ames Hydro Electric Penstock Inteerity <br />Dear Mr. Shuey and Ms. Linden: <br />We represent Public Service Company of Colorado ("PSCo") in connection with its <br />concerns regarding the stability of certain sections of slope contiguous to the path of PSCo's <br />Ames Hydro Electric Penstock and also adjacent to certain stretches of haul road included <br />within the permitted area for the Pathfinder Pit in San Miguel County that is operated by <br />Pathfinder Development, Inc. <br />Specifically, in respect of the presently pending enforcement actions involving the <br />Pathfinder Pit that are scheduled for consideration by the Colorado Mind Land Reclamation. <br />Board at its September 2000 meeting, please be advised that PSCo has retained a consulting <br />geotechnical engineering firm that will be providing a report concerning the stability of the <br />slope area contiguous to the PSCo Penstock and the Pathfinder haul road. This geotechnical <br />report will also recommend critically important remedial measures that need to be taken in <br />respect of the marginally unstable present condition of the slope in this area. We anticipate <br />submitting this report to the Mind Land Reclamation Board and the Division of Minerals and <br />Geology on Friday, September ] 5, 2000. We believe that consideration of the report and the <br />related recommendations of our consulting geotechnical engineers will be critical in <br />evaluating appropriate regulatory enforcement actions. <br />Denver Minneapolis Des Moines London Frankfurt <br />
