In; <br />particular, Flatiron Paving Co. has failed to follow the approved plan with're- <br />spect to sediment control and some aspects of topsoil salvage. <br />Notice of Violation N80-29 has been issued for failure to construct sediment <br />ponds and diversion ditches prior to any other disturbances, which is required <br />by both the Colorado Surface Goal Mining Reclamation Act (34-33-120 J) and the <br />Federal interim regulations (715.17 a). Appeals procedures are explained on <br />the enclosed Plotice of Violation, however feel free to call if you have further <br />questions. <br />A violation wets not issued for the topsoil salvage problems identified during <br />this inspection. However, you should be aware that this Division considers <br />these to be st:rious problems, which must not be repeated in the future.
