On April 22, 1987, the Mined Land Reclamation Board conducted a formal public
hearing for consideration of Notice of Violation, Cease and Desist Order,
civil penalties and corrective action for failure to maintain financial
warranty in good standing on each of the above referenced mining permits.
Based on evidence provided by CFBI Steel, that the Canon Dolomite Quarry has
been under temporary cessation since 1983 and all mining activates have
ceased, the Mined Land Reclamation Board ordered that CF&I Steel provide the
Division with a written stipulation that CF&I Steel will not go out of
temporary cessation without giving a 30-day advance notice to the Board with a
description of what the planned activities are going to be so tfiat the staff
can determine what if any additional bonding needs to be submitted. If this
commitment is submitted in writing prior to the May Board Meetinq, the
enforcement actions will be terminated. If this is not received prior to the
May Board Meeting, this entire enforcement action will be re-opened at the May
Board Meeting.
As to File Number M-77-377, the Monarch Ouarry, the Board found a violation
for failure to maintain financial warranty in good standing, issued a Cease
and Desist Order with corrective actions and assessed a civil penalty. To
support those actions, the Board issued the enclosed Findings of FAct and
Conclusions of Law.
