Andersen: As you know, on September 23, 1982, the Pained Land Reclamation Board issued a cease and desist order to you an the above captioned operation and levied no civil penalty against you, on the condition that a permit for this opera- tion is issued to you within 60 days of that meeting. The 60-day period runs out on November 22, 1982. The next Mined Land Reclamation Roard meeting ([o be held in Room 110 of our building) is to be held on November 17-18, 1982. If a permit application for this site is not approved during this meeting, the cease and desist order will remain in effect against Andersen Construction Company and the matter of a possible civil penalty should be considered again by the Board. In my letter to you of August 18, 1982, I outlined the procedure necessary to complete the permitting of the pit. To date, I have received the financial and performance warranties and the proof of pub]ication. The other matters that still need Co be suhmitted are a reply to my adequacy letter of. April 2, 1982, (including the legal description of the operation to the nearest 4 ~Z section), and a reply to my inspection report of September 20, 1982. The performance and financial warranties are adequate except for the following details: I) Do you wish to call this operation the Powell Construction Company Pit or the Lyle Smith Pit? The latter name appears at one point on the performance warranty. 1']ease make the pit name consisCent throughout both forms. 2) 7s the operator to he Andersen Construction Company or Dale Andersen Construction Company? 1'he former name appears on the performance warranty and the latter name nn the financial warranty. 3) F'hat is the bond number that should appear on page 1 of the financial warranty? 4) Both wan'anties will require the addition of the legal description of this pit to the nearest ';:'~ section as "Exhibit A."
