Banta. <br />Diwson Director <br />RE: OSM/AFO Inspection Report of August lo, 1990, Peabody Coal Company, <br />Nucla Mine, Permit C-81-U08 <br />Dear Mr. Hagen: <br />The Divisiun would like to take this opportunity to comment on t<vo statements <br />made in the above-referenced inspection report that we feel are incorrect or <br />misleading. <br />First, the inspection report states on page one in the second paragraph that <br />"...the main channels or diversion directing flows into the impoundment trom <br />disturbed areas above the structure were installed without consideration to <br />prevent or reduce downcutting with soma type of channel protection." We <br />believe that this statement is misleading. The inlet to sediment pond 005 had <br />been riprapped, and the inlet to sediment pond 004 had been excavated to <br />bedrock. We believe that this demonstrates that there was consideration given <br />to preventing erosion. <br />Second, the second paragraph of page 5 of the inspection report addresses the <br />"ash ramp" adjacent to the mine permit area. This area was used for disposal <br />of ash waste matxrial from the Nucla power plant some years ago. This area <br />was mined pre-law and was never included in the permanent program permit. <br />Therefore, we do not believe it appropriate to include any discussion of this <br />area in the inspection report. <br />if you have any questions feel tree to call. <br />Sincerely, <br />Susan J.
