The purpose <br />of th s letter Is to GarHy some ina~urades in Findinga of Fact, Conelusions of Law, and Order <br />(he after "Order') end follow-up en some kerns mentioned therein. <br />As preliminary matter, the Jankes will not be petlUoning the MLRl3 to reeonslder tts <br />Ord r, es to do so would most likely be futile. However, there are Some Incorrect statements <br />ma in the Order. <br />First, with rega-d to Paragraph No. 8 in the Order, I am unclear ae to why these <br />ells ations era eontalned In the Order. There was absolutely no dlscueslan at the MLRB <br />hea 'ng on any issues related to release of pollutants to the surface dralrlage system below the <br />em nkment or dlsturbanee to the hydrologic balance. If the Division alleges that Pathfinder <br />has iolated C.R.S, seetlon a3-32.5-116(4)(c), (h), (i), and ((), as the Order states, then the <br />DM should take appropriate actions, pursuant to ks own rules and regulations, and notify the <br />Divi ion of Water Quality so that there een be a meaningful investigation into these serious <br />ells ations. Please respond in writing and advise eonceming the Divisions current posftlon with <br />rag rd to possible violations o1 these statutes and its plena, if any, to take the required aetlon <br />with regard to these allegations, <br />Second, with regard to Paragraph Na. 8 in the Order, the first pipeline break was in <br />199 ,not 1997, and it you review the transcript from the actual hearing ah September 21, 2000, <br />you 11 note some eoniuslon, but ult(mately this fact is clarified. <br />Third, with regard to Paragraph No, 12 In the Order, Mr, Janke did not testify that when <br />the ipeline ruptured In 1997 (really 1996), his home suffered flood damage.
