Shelton <br />Director <br /> <br />June 16, 1981 <br />T0: Bob Liddle O <br />FROM: Jim Pendleton <br />SUBJECT: Overburden Iss s Zn t Energy Fuels No. 3 Permit Application <br />Pursuant to your request I have taken a preliminary look at the Energy <br />Fuels No. 3 permit application. I forward the following comment for <br />your consideration. <br />Zf the permanent overburden pile indicated on map number 6 in Section <br />number 29 will not be disturbed by operations permitted in this permit <br />period, the pile would be considered an existing structure and need not <br />be brought into conformance with the permanent program regulations. Z <br />would, therefore, concur with Energy Fuel's position as stated on page <br />9.09-12 of their application. <br />However, any spoil or underground development waste which wi1Z be placed <br />in a pile, temporary or permanent, must meet the performance standards of <br />Rule 9.09. I will be glad to review their treatment of the temporary <br />spoil piles during my review of the application which I hope to complete <br />late this week or next week. <br />Map number 6 also refers to areas limited to 50"o extraction, which Z <br />assume are also potential Alluvial Valley Floors which they intend to <br />~~ undermine. Needless to say, the implication that SOro extraction will <br />prevent sub"sidence will have to be appropriately technologically <br />justified.
