Long <br />Division Dueuor <br />The Division received your letter dated April 16, 1996 which indicated that Twin Pines <br />Investment Limited Partnership is unable to comply with the conditions of the Twin Pines <br />permit. Because the cessation order which prompted your letter is unabated, the enclosed <br />Show Cause order is being issued today. <br />Please note that you have the right to request a hearing before the Mined Land <br />Reclamation Board in regard to the Show Cause order. If such a hearing is requested, the <br />assessment of civil penalties associated with NOV's C-96-007 and 008 and Cessation Order <br />C-96-009 could be discussed concurrent with the consideration of permit revocation and <br />bond forfeiture. If you wish to schedule such a hearing for the regularly scheduled Board <br />meeting in May, your request should be received by May 2, 1996. The May Board meeting <br />is scheduled to begin at 10:00 a.m. on May 22, 1996 in the Elks Lodge in Victor, Colorado. <br />It would be helpful if, in your request for a hearing, you indicated whether Twin Pines <br />intends to contest the Show Cause Order. The Board would probably also want to know <br />why Twin Pines is no longer able to comply with the mine permit. <br />
