Nov cv-ss-oo2 <br />New Horizon Mine <br />This NOV was issued for failure to conduct blasting in a manner to prevent <br />damage to public or private property outside the permit area. <br />HISTORY <br />No NOV's have been issued at this site during the past twelve months. No <br />penalty is assessed for history. <br />SERIOUSNESS <br />Fly rock left the mine permit area and damaged a structure owned by an entity <br />other than the mining company. This is judged to be reflect significant degree of <br />seriousness since it an off-site impact occurred and property was damaged. <br />$1250 is assessed for seriousness. <br />FAULT <br />A failure of the pit high wall apparently created the circumstances that led to the <br />problem with the blast cited in this NOV. The operator appears to have assessed <br />the situation and considered possible ways of dealing with it prior to setting off <br />the blast. They appear to have taken some steps to protect a nearby street from <br />damage. A statement in a March 31, 1999 memo provided by the operator <br />indicates that, "this accident was unavoidable". However, it is not clear to this <br />assessment officer that all possible measures were taken to avoid the violation. <br />$250 is assessed for a low degree of negligence. <br />GOOD FAITH <br />The NOV has not yet been abated and terminate so, consideration of good faith <br />is not appropriate at this time. <br />
