Lamm <br />Governor <br />March 25, 1986 - <br />Mr. Jack Gilleland <br />C and J Gravel Products <br />514 County Road 509 <br />Ignacio, Colorado 81137 <br /> <br />DIVISIO N <br />Re: Montoya Pit - File No. M-80-116 - Action taken at the March 20, 1986 <br />Meeting of the Colorado Mined Land Reclamation Board <br />Dear Mr. Gilleland: <br />Action by the Colorado Mined Land Reclamation Board at their meeting resulted <br />in the issuance of the attached Notice of Violation and Cease and Desist <br />Order. The Cease and Desist Order requires immediate cessation of all mining <br />operations and other corrective measures. I suggest you read it thoroughly. <br />This matter will be on the Board agenda as a Formal Public Hearing on <br />April 23-24, 1986 for consideration of possible civil penalties. At the <br />hearing, which will be held in Room 110 of 1313 Sherman Street, Denver, <br />Colorado beginning at 9:00 a. m. or as soon thereafter as the matter can be <br />considered, you will have the opportunity to be represented and heard. It <br />will be reiterated that you have been found in violation of the permit, <br />specifically the following provisions: <br />Exhibit E of Permit No. M-80-146 and CRS 34-32-116(1)(1) <br />Your attention is called to the following provision from C.R.S. 34-32-124(7): <br />"Any person who violates any provision of any permit issued under this article <br />shall be subject to a civil penalty of not less than one hundred dollars per <br />day nor more than one thousand dollars per day for each day during which such <br />violation occurs; except that any operator who operates under a permit issued <br />under Section 34-32-110 shall be subject to a civil penalty of not less than <br />fifty dollars nor more than two hundred dollars per day for each ddy during <br />which violation occurs." <br />If you have any questions, please contact us. <br />Sincerely, <br />i~ <br />,. <br />Karen A.
