Cattany <br />Division Director <br />Natural Resource Trustee <br />On Septetmber 28, 1994 the Division of Minernls and Geology (Division) approved an amendment to the l l2c permit for <br />the Mekelburg Pit No. 1, which added additional acreage to the permit. As part of the approval of this permit amendment, <br />two stipulations were issued which were to be completed prior to disturbance m the amended acreage. The stipulations area <br />as follows: <br />NO MINING RELATED DISTURBANCE MAY OCCUR UNTIL A CULTURAL RESOURCES SURVEY IS <br />MADE OF THE APPLICABLE AREAS OF THE PERMIT AREA AND THE COLORADO HISTORICAL <br />SOCIETY HAS EITHER CLEARED THE SITE OR AGREED TO ANY NECESSARY MITIGATION. <br />PROOF OF SITE CLEARANCE OR MITIGATION MUST BE PROVIDED TO THE DIVISION PRIOR TO <br />MINING. A REVISION TO YOUR APPLICATION MAY BE NECESSARY (F SITE MITIGATION ALTERS <br />THE MINING OR RECLAMATION PLAN. <br />2. NO MINING RELATED DISTURBANCE MAY OCCUR IN AREAS ADDED TO THE PERMIT BY THIS <br />AMENDMENT UNTIL A WETLANDS SURVEY IS MADE OF THE ENTIRE PERMIT AREA AND THE <br />ARMY CORPS OF ENGINEERS HAS EITHER CLEARED THE SITE OR AGREED TO NECESSARY <br />MITIGATION. PROOF OF SITE CLEARANCE OF MITIGATION MUST BE PROVIDED TO THE <br />DIVISION PRIOR TO MIMNG IN AREAS ADDED TO THE PERMIT BY THIS REVISION. A REVISION <br />TO YOUR PERMIT MAY BE NECESSARY IF SITE MITIGATION ALTERS THE MINING OR <br />RECLAMATION PLAN. <br />Although Division records indicate compliance with stipulation number one, the Division does not have documentation that <br />stipulation number two was fulfilled.
