(Z) If the l=lAD cyanide level :~ithin an active taiiicgs pond a.,ceej;,l5 pcm, 6,4RI <br />shall immediately notify the Division and cease thz rzleasz of ~ailings and <br />liquids from the pie processing plant to the active tailing; pod until it has <br />achieved 15 ppm or less WAD cyanide concentration in the active, tailings pond. <br />(3> If the WAD cyanide level within an inactive tailings pond exceeds 10 ppm, BMRI <br />shall immediately notify the Division and shall take all necessary steps to <br />return the pond to 10 ppm or less. In addition, 6MRI shall not initiate the <br />release of tailings and liquids from the ore processing plant ttD the inactive <br />tailings pond until it has achieved 10 ppm or less WAD concentration in the <br />pond. <br />(4) BMRI is to use all reasonably practical steps to continue to 1o er the cyanide <br />levels in ill tailings ponds to the lowest reasonably achievabl levels, and to <br />continue to use its best efforts at all times to achieve that g a1. If at any <br />time the staff, or other parties, believe that BMRI is not doin everything <br />reasonably practical, BMRI can be brought back to the Board for further action, <br />including civil penalties and further corrective action orders. <br />(5) BMRI also proposes to implement the INCO S02/Air tailings treat ent process <br />described in TR-O10 as a final process to achieve and maintain c mpliance with <br />the cyanide level permit standards specified in the permit. TR- 10 was <br />submitted to the Division on June 16, 1992 and is currently under review. BMRI <br />shall commence operation of the INCO Process as soon after appr al as <br />possible, in accordance with the schedule for implementation contained in <br />TR-010. <br />(6> Upon implementation of the INCO tailings treatment process, BMRI shall commence <br />treatment of the the active tailings pond to bring it into compliance with the <br />permit standards of 4.4 ppm total Cyanide and 3.8 ppm WAD cyanid as rapidly as <br />possible. After the active tailings pond has achieved compliant with the <br />permit standards, BMRI shall commence treatment of the inactive M~tailings pond <br />to bring it into compliance with the permit standards as rapidlyas possible. <br />(7> BMRI received verbal approval for the installation of the two ad itional ground <br />water monitoring wells proposed within its technical revision TR 008 on July 7, <br />1992. No later than August 6, 1992, BMRI shall install, complet , <br />hydrologically test, geophysically log, and sample the wells. B Ri shall also <br />evaluate the data and submit a report presenting Bh1RI's conclusi n regarding <br />the necessity of additional ground water monitoring modification . <br />Wi-iin thirty days following the Division's approval of the eval ative report <br />submitted in accordance with TR-008, BMRI shall install and comp ete any <br />necessary additional ground water monitoring wells. <br />If BMRI fails to meet any of the above deadlines, or any leakage!1s detected <br />from the tailings impoundment, BMRI shall immediately notify the Division and <br />cease operation of the ore processing plant. <br />(8) The Division, and any other party wishing to do so, shall provid~ the Board <br />with monthly reports on the status of the tailings pond detoxifi ation process, <br />until such time as cyanide levels within the tailings ponds have .re turned to <br />compliance with the permit standards. <br />
